Appeal against a finding that the Claimant (who was on maternity leave) had been subject to unlawful direct discrimination when she was classed as a leaver as a result of the employer’s blanket application of a policy of treating employees who had been absent without pay for a period of three months as leavers and erasing them from employment records. Appeal allowed and remitted to the same Tribunal.

Claim by 210 judges that changes to the Judicial Pension Scheme amounted to less favourable treatment because of their age and in some cases race and sex. The claim was upheld.

Application to re-amend the amended grounds of appeal after the ET upheld a claim of a breach of the sex equality clause provided for by s66 of the Equality Act 2010 (i.e.an equal pay claim), as a result of which two claims of constructive dismissal and a claim of wrongful dismissal were also upheld.
