Appeal against a ruling that the Claimant's payment in relation to a settlement agreement fell within section 401(1)(a) of ITEPA 2003 and was thus taxable and against the decision that awards for injury to feelings are taxable. The appeal was allowed in relation to injury to feelings.

Gomes v Higher Level Care Ltd [2018] EWCA Civ 418
Appeal against a decision by the ET, and upheld by the EAT, that the ET does not have the power to make an award of compensation for injury to feelings where there has been a breach of the Working Time Regulations 1998. Appeal dismissed.

Consultation on Vento bands uprating published
The Presidents of the Employment Tribunals of England & Wales and Scotland have released a consultation document which suggests how the so-called Vento bands could be amended to take into account the rate of change of inflation since Da'Bell v NSPCC and the Simmons v Castle 10% uplift.
