Application for permission to appeal an EAT judgment which overturned the ET’s findings of unlawful disability discrimination on the basis of failure to make reasonable adjustments and detriment on the grounds that the claimant had made one or more protected disclosures. Application granted.

Appeal against decision that the claimant, disabled within the meaning of the Equality Act, had been unfairly constructively dismissed in cirucmstances where it was submitted that the employer had failed to make a reasonable adjustment by requiring he claimant to attend a meeting with his line manager and so was a breach of contract. Appeal allowed on the issue of breach of contract and case remitted for futher hearing on issue of discrimination.
