Sattar v Citibank NA & Anor UKEAT/0336/16/LA

Appeal against the dismissal of the Claimant’s claims of disability discrimination and unfair dismissal. Appeal dismissed.

The Claimant, who was disabled, lost his claims of unfair dismissal and disability discrimination at the ET, after he was dismissed over complex financial issues arising from an investigation by HMRC. He had claimed that reasonable adjustments should have been made to the disciplinary process and that the application of 3 PCP's resulted in substantial disadvantage to the Claimant. He appealed the ET decision.

The EAT dismissed the appeal. The ET was entitled to make findings as to the reasonableness of an investigation and subsequent disciplinary process, and as to the effect the Claimant's admitted disability had upon that process, including whether PCPs applied resulted in the Claimant being placed at a substantial disadvantage in comparison with persons who were not disabled.
