Broma v Bakkavor Food Ltd T/A Bakkavor Desserts Highbridge UKEAT/0078/18/BA

Appeal against the dismissal of the Claimant's claims of unfair dismissal and disability discrimination under sections 13, 15 and 20 of the Equality Act 2010. Appeal dismissed.

The Claimant, who had limited command of the English language, was dismissed on capability grounds and she lost her claims on unfair dismissal and disability discrimination at the ET (at which she represented herself and had the benefit of an interpreter). She appealed on the grounds that she had not had time to cross-examine the Respondent properly and the ET's conclusions on reasonable adjustments were perverse.

The EAT dismissed the appeal, preferring the evidence of the ET that the cross-examination lasted far longer than the Claimant recollected. On the reasonable adjustments ground, the evidence which the ET had accepted from the Respondent's witnesses provided an ample basis for its overall conclusion.
