The Ministry of Justice v O'Brien UKEAT/0466/13/LA
Following a ruling that part-time fee-paid judges are entitled to a pension, the ET determined the amount of the pension that should be payable. The respondent appealed the way in which the pension was calculated. Appeal allowed on the main issue.

Appeal against an ET ruling that the claimant’s civil partner was entitled to a pension on the claimant’s death even though the claimant’s service occurred entirely prior to coming into force of the law prohibiting discrimination on the ground of sexual orientation. Appeal allowed.

British Telecommunications PLC v Luck & Ors [2014] EWHC 290 (QB)
Application by defendant to strike out claim of tort as time-barred where the claimants, former employees of the respondent who had been TUPE’d to a joint venture, were seeking compensation because they had subsequently lost their final salary pension benefits. Application unsuccessful.

Appeal against a decision that the claimants, who were bringing age discrimination claims, were in materially different circumstances to the comparators and so the claim should be dismissed. Appeal allowed and the objectivity issue was remitted to the same Tribunal for determination.
