In a case concerning restrictive covenants, the Claimant was seeking a declaration that the defences of the defendants had been struck out as a result of a breach of an unless order; in the alternative they sought summary judgment in relation to a number of issues in the claim. The defendants denied they were in breach of the unless order and if they were they sought relief from sanctions; they also sought dismissal of the application for summary judgment. The claimant’s applications were refused.
