Zagorski v North West Anglia NHS Foundation Trust [2024] EAT 164

Appeal over decision that the claimant was not disabled at the relevant times for his claim.

HHJ Tayler found it was perverse for the judge to have found the twice weekly migraines, which persisted even after the claimant had modified his behaviour, could not amount to an impairment of day to day activities. He therefore substituted a finding that the claimant was a disabled person at the material times.
