Thomas v Expansys UK Ltd [2022] EAT 164

Appeal against decision to strike out claim for victimisation, discrimination and other matters in circumstances where a judge in the ET had put the claimant (a litigant in person) 'on the spot' by asking her to clarify the nature of her claims during the strike out hearing

John Bowers KC, sitting as a Deputy High Court Judge, dismissed the appeal as the ET had not erred in law and the decision was not perverse. The tribunal has the option to strike out if there was no causation pleaded in respect of the sole person who was alleged to have discriminated against the claimant. While he found it was unfortunate that the claimant had been put on the spot there had been many missed opportunities for her to clarify what her case was on this point, but she had not done so.
