Rentokil Initial UK Ltd v M Miller [2024] EAT 37

Appeal concerning whether the ET had erred by regarding the giving of a trial period in a new role as a reasonable adjustment where the claimant could, in the employer's eyes, could no longer continue in their current position as a result of his MS.

IN his summary, HHJ Auerbach concludes 'there is no rule of law that it cannot be a reasonable adjustment to give them a trial period in a new role. Nor is there any rule of law that it must be certain, or likely to some particular degree, that the employee will be successful in a trial.'
