Connor v Chief Constable of South Yorkshire Police [2024] EAT 175

Appeal against dismissal where the claimant was arguing mitigation through a disability.

The claimant, a civilian employee of the police, was dismissed for accessing pornography on a work computer but pleaded mitigation on grounds of his health. The ET rejected the claims as it considered the dismissal was justified in the circumstances as there was a legitimate aim of ensuring standards of behaviour were maintained and to protect public confidence.

In this appeal, the claimant argued he had been denied opportunities for evidence in chief and re-examination. HHJ Beard rejects those submissions as factually incorrect and found there was no procedural irregularity.
