Canning v National Institute for Health and Care Excellence UKEAT/0241/18/DA

Appeal against the ET’s decision dismissing the Claimant’s claims of unfair dismissal and sex and age discrimination. Appeal dismissed.

The Respondent undertook a reorganisation of the team in which the Claimant worked, whereby nine employees were effectively competing for six posts. The Claimant was not appointed to one of the new posts, and she brought claims, as a litigant in person, of unfair dismissal and sex and age discrimination. The ET dismissed the claims, and the Claimant appealed on the main ground that, in considering whether the dismissal was fair, the ET failed to properly take account of the guidelines in Williams & others v Compair Maxam Ltd.

The EAT held that the ET had not erred in law in reaching its decision, and so the appeal would be dismissed.
