Ahmed v The Cardinal Hume Academies UKEAT/0196/18/RN

Appeal against the ET’s rejection of the Claimant’s claims of discrimination, harassment and unfair constructive dismissal. Appeal dismissed.

The Claimant, who has dyspraxia which makes it difficult for him to write for more than a few minutes due to pain in his hands, was offered a Teach First placement with the Respondent school. Following meetings with representatives of the Respondent to address potential concerns about the effect of the Claimant's dyspraxia on his work, the Claimant felt that he had been treated unfairly and in a hostile manner, and he brought claims of discrimination, harassment and unfair constructive dismissal. The ET rejected the claims, and the Claimant appealed on the grounds that (1) the ET had failed to apply the provisions of s 26 Equality Act 2010 ("EqA") in considering whether there had been harassment, and (2) the ET had erred, in relation to the claim of direct discrimination, in failing to give effect to its own finding that the reason for the Claimant's suspension was his difficulty in handwriting.

The EAT held that the ET did not err in its application of s 26 EqA or in relation to the direct discrimination claim.
