Appeal against a ruling that rejected a father’s argument that death in service benefits was a real loss of substance to his son, who had died within days of being dismissed. Appeal allowed and a decision substituted to the effect that the claimant’s loss, if unfair dismissal and/or discrimination was proved, was equivalent to 3 years’ pay.

Greater Glasgow Health Board v Lamont UKEATS/0019/12/BI
Appeal against a decision that the claimant, who worked a 2 year fixed term contract whilst another employee was on secondment, was entitled to a redundancy payment on termination of the contract. Appeal allowed and ruling that the claimant had not been made redundant was substituted.

Boardman v Nugent Care Society and Board of Goverors of Clarence High School UKEAT/0071/12/CEA
Appeal against an earlier EAT decision to remit the case, which involved allegations of assault by a teacher on a pupil, to a fresh tribunal where the ET had originally found there had been a fair dismissal but the EAT had concluded that the ET had failed to properly consider certain material evidence. The decision of the EAT was upheld.

Appeal against finding that a dismissal was fair where the EAT had set aside the original decision and did not remit the matter so dismissed the claims altogether. Appeal allowed.
