A reasonable restriction? - Case Round-Up: July 2017
In this month's round-up, Mark Shulman, consultant solicitor with Keystone Law, looks at recent cases on injunctive relief to enforce restrictive covenants and garden leave.
ICAP Management Services Ltd v Berry & Anor  EWHC 1321 (QB)
The court had to determine whether an injunction placed upon the first defendant preventing him from taking up employment with the second defendant until the end of his 12 month garden leave should be continued. The injunction was enforced.
JM Finn & Co Limited v Holliday  EWHC 3450 (QB)
Appeal against the imposition of an injunction which prevented the employee from taking up his new position with a competitor until the expiry of his 12 month garden leave. Appeal dismissed.
