Abrahall & Ors v Nottingham City Council & Anor UKEAT/0010/16/JOJ
Appeal against the dismissal of the Claimants' claims of unlawful deductions after their pay increments were frozen. Appeal allowed in respect of one group of Claimants.

Milanese v Leyton Orient Football Club Limited [2016] EWHC 1161 (QB)
The Claimant claimed the sums specified in his contract of employment as falling due on termination without notice. In the alternative, he claimed damages for wrongful termination. The Defendant counterclaimed for substantial sums, arguing that the Claimant owed and had breached fiduciary duties owed to the Defendant. Both the claim and counterclaim were dismissed.

Colletti v Borealis Driver Services Ltd & Anor UKEAT/0203/15/RN
Appeal against a variety of claims which were either dismissed or struck out, and against deposit orders that had been imposed on the Claimant. Appeals from the deposit orders in respect of notice pay and nights out allowance allowed.

Farmer v Heart of Birmingham Teaching Primary Care Trust & Ors UKEAT/0180/15/LA
Appeal against a finding that the Claimant, at all the material times, was not an employee of the Trust but of the Council and that he therefore could not claim unfair dismissal or a redundancy payment against the Trust; nor against the Third Respondent, the Secretary of State for Health, who would have inherited liability for unfair dismissal compensation or any redundancy payment if the Trust had been under any such liability. Appeal dismissed.

Elliston v Glencore Services (UK) Ltd [2016] EWCA Civ 407
Appeal against a decision that the appellant employer was in breach of contract in not paying the respondent employee a sum, defined under the latter's contract of employment as "the Prescribed Sum". Appeal allowed.

ESS Support Services LLP v Pabani & Compass Group PLC UKEAT/0161/15/DA
Appeal against a finding that the Claimant, a British citizen living (and recruited) in the UK, but based in Kazakhstan, was employed by a Kazakhstani company, albeit in circumstances in which there was a sufficiently strong connection with Great Britain for there to be jurisdiction to hear the claim. The Claimant cross-appealed a finding that he was not employed by the UK-based group company. Appeal allowed and cross-appeal dismissed. The case was remitted to a different Employment Judge.

Appeal against a finding that the Claimant’s dismissal was unfair and wrongful. Appeal allowed and alternative findings substituted to the effect that the Claimant’s unfair and wrongful dismissal claims both fail.

Respondent’s appeal against a finding that it unfairly and wrongfully dismissed the Claimant; and Claimant’s cross-appeal against a finding of contributory fault. Respondent’s appeal allowed and findings of unfair and wrongful dismissal set aside. Claimant’s cross-appeal dismissed.
