Sandhu v Enterprise Rent-A-Car Ltd [2023] EAT 169

Appeal against the dismissal of the Claimant's claims of unfair dismissal and disability discrimination. Appeal dismissed.

The Claimant was dismissed following concerns over her performance and her reluctance to report to a certain member of staff. She appealed, saying that the reason for dismissal was because of (or connected to) her father’s diagnosis of stage 4 cancer. Her appeal was rejected and the Claimant brought claims of unfair dismissal and disability discrimination to the ET. The ET dismissed all her claims and she appealed to the EAT.

The EAT dismissed the appeal. The ET did not err in law in rejecting the claims of unfair dismissal, direct disability discrimination and harassment. The ET considered the relevant issues and provided proper reasons for its conclusions. The determinations of the ET were not perverse.
