Munchkins Restaurants Ltd & Anor v Karmazyn & Ors [2010] EWCA Civ 1163
Application to appeal against findings by the ET, which were upheld by the EAT, that several waitresses had suffered discrimination, harassment and were unfairly constructively dismissed. It was submitted that the ET did not consider whether the claims were in time and their approach, when considering the individual claims, was too 'broad brush'. The respondent also questioned the issues of joint and several liability and whether it was rational to make the same award to each of the claimants. Application refused.

Woodward v Santander UK Plc (Formerly Abbey National Plc) UKEAT/0250/09/ZT
Appeal against decision by ET that the claimant had not been victimised or discriminated against. In particular, the Tribunal ruled that the claimant could not use evidence which formed part of ‘without prejudice’ negotiations, nor could she amend her claim form to introduce an actual comparator to help in her discrimination claim as none had been referred to in previous proceedings. Fullerton v Interights International Centre For The Legal Protection Of Human Rights UKEAT/0251/09/RN
Appeal against decision that complaints of race discrimination, racial harassment and sex discrimination should be dismissed as the claimant had not complied with s 32(2). Appeal succeeded. Also, the EAT held that the ET had erred in law in holding that the claimant was time barred from proceeding with discrimination complaints and ruled that the merits Tribunal should decide time points entirely afresh. Cross appeals from the employer failed.
