Michalak v General Medical Council and others [2017] UKSC 71
The GMC was appealing against a decision of the ET that it had jurisdiction to hear the Claimant's complaint of discrimination - the GMC argued that section 120(7) of the Equality Act 2010 meant that the ET did not have jurisdiction to hear the claim, as judicial review already provides for an appeal in these matters. The appeal was dismissed.

BMC Software Ltd v Shaikh UKEAT/0092/16/DM
Application to re-amend the amended grounds of appeal after the ET upheld a claim of a breach of the sex equality clause provided for by s66 of the Equality Act 2010 (i.e.an equal pay claim), as a result of which two claims of constructive dismissal and a claim of wrongful dismissal were also upheld. The application was allowed.

Rule 3(10) application against the dismissal of the Claimant’s claims of constructive unfair dismissal. The Notice of Appeal disclosed some reasonable grounds for bringing the appeal and these grounds were directed to proceed to a full hearing.

Folkestone Nursing Home Ltd v Patel UKEAT/0348/15/DM
Appeal against a finding of unfair dismissal and an ACAS uplift that was applied to the award. Cross-appeal against a 60% reduction in the award for contributory fault and a failure to mitigate losses. Appeal allowed and a finding that the Claimant was not dismissed was substituted.
