Bennoch v Scottish Power Limited and others [2025] EAT 61

Appeal against a refusal by the President of Employment Tribunals in Scotland to reconsider an earlier judgment reached by a now-retired judge and members. Appeal dismissed.

The Claimant was dismissed in 2017 and had requested reviews or appeals of the decision several times since then. Correspondence continued during 2022 and 2023 where the Claimant copied to a host of court and tribunal jurisdictions and legal organisations across the UK, journalists, the First Minister, and a variety of MPs and MSPs. The Claimant’s correspondence had become increasingly florid, extending far beyond his ongoing critique of the ET’s original judgment, and in one email, he accused judges of abusing their office to make his case “disappear”. He has similarly accused them of misconduct in public office. This hearing was a rule 3(10) hearing to consider whether the Claimant's fifth and sixth appeals had reasonably arguable grounds such that they should be permitted to proceed to a full hearing.

The EAT dismissed the appeal. The EJ's approach when considering the fifth and sixth appeals disclosed no reasonably arguable error of law.
