Appeal against a decision not to allow the Respondent’s application for an extension of time to serve its response to the Claimant’s ET claim. Second appeal against a decision that the ET would determine remedy without need for a hearing and refusing the Respondent’s request to participate in the remedy stage of the proceedings after a liability hearing upheld the Claimant’s claims. First appeal allowed and remitted to the same ET, second appeal dismissed.

Amissah & Ors v Trainpeople.co.uk Ltd (Dissolved) & London Underground Ltd UKEAT/0187/16/DA
Appeal against the level of compensation awarded to the 31 Claimants after it was found that the Employment Agency and the hirer had breached Reg 5(1) of the Agency Workers Regulations 2010. Appeal allowed and remitted to another Tribunal Judge to determine the amount of compensation that should be paid to the Claimants.

BMC Software Ltd v Shaikh UKEAT/0092/16/DM
Application to re-amend the amended grounds of appeal after the ET upheld a claim of a breach of the sex equality clause provided for by s66 of the Equality Act 2010 (i.e.an equal pay claim), as a result of which two claims of constructive dismissal and a claim of wrongful dismissal were also upheld. The application was allowed.

Appeal against a decision that the ET had jurisdiction to hear the Claimant's second claim, the Respondent arguing that the signing of a COT3 in relation to a previous claim precluded the Claimant from bringing the second claim. Appeal dismissed.

Appeal against findings that the Claimant suffered unlawful disability discrimination and had been unfairly dismissed. Cross-appeal against a finding that the Claimant's claims pre-dating the lodgement of her first claim amounted to Henderson abuse. Respondent's appeal allowed in part, Claimant's appeal dismissed.
