Appeal concerning allegations of apparent bias where one of the claimants, who was also representing others, had not realised he could apply for the judge to recuse himself when that judge had both advised him as a solicitor, and sat as an ET chair, in separate proceedings in 1999, which had themselves resulted in an appeal that concluded the judge should have withdrawn. Judgment set aside and a rehearing ordered.
