Appeal against the rejection of the claimant’s claim of race discrimination which was barred by issue estoppel. Appeal dismissed.

Appeal against a decision by the ET that claims of unfair dismissal should be struck out as being res judicata by reason of the first judgment, or alternatively as an abuse of process. Cross-appeal against a ruling that the claimant’s claim in respect of a guarantee payment should be heard. Claimant’s appeal allowed, respondent’s cross-appeal dismissed.

Appeal against refusal to strike out breach of contract proceedings relating to compensation for discrimination where the alleged discrimination had not been found in the ET, though a later claim for victimisation had been successful. Appeal dismissed.
