"The appellant complained to the Certification Officer that his union had disciplined him in breach of the union’s rules. His application was struck out by the Certification Officer as having no reasonable prospects of success on the basis that the appellant’s interpretation of the rules was incorrect. It was an error law for the Certification Officer to strike out the application in circumstances where the rules were ambiguous, such materials as were before the Certification Officer did not demonstrate that the appellant’s interpretation was not reasonably arguable, and the Certification Officer did not have before her all of the evidence necessary to decide the issue.
