Pease v Henderson Administration Ltd [2019] EWCA Civ 158
Appeal from a High Court decision in an employment dispute, raising one question of construction of the Respondent’s contract of employment with the Appellant company. Appeal allowed.
The Court of Appeal set aside the finding that the Appellant was in breach of the relevant clause of the contract, and upheld the Appellant's counterclaim. As regards the quantum of the counterclaim, unless the parties could reach agreement, the proceedings would be remitted to the High Court for an account to be taken of what was due to the Appellant.
