Gurney v Randall & Ors [2026] EAT 4

Application for costs. Application refused.

The Respondent made an application for costs after the Claimant's appeal failed.

The EAT refused the application, concluding that the threshold relied upon by the Respondent for making an award of costs had not been surpassed and so rejected the application for costs. If the EAT had concluded that the appeal was misconceived it would have only just surpassed the threshold and would have refused the application.
