The claimant brought an unfair dismissal claim and sought to amend it by adding termination of agency engagement. The Judge rejected this largely on the basis that she was represented by solicitors at the time the claim was presented. Unusually the EAT was prepared to overturn the Judge on the question of amendment because the claim was at an early stage and the prejudice to the Respondent detected by the Judge would not be great.
