Appeal against dismissal of discrimination claims where the claimant had been considered for redeployment

The claimant started work with the respondent and his duties included patrolling his workplace on foot but also working on the front desk. Soon after he started work, his plantar fasciitis flared up and as he was unable to fulfil his duties he was placed on the redeployment register. He applied for three roles without success before being dismissed. Before the ET he argued a reasonable adjustment would have been to give him longer to find a new role before dismissal or that he should have been given a receptionist role. The ET, while critical of some of the respondents actions, found dismissal was proportionate because any potential lesser measure had already been addressed.

In this appeal, Sarah Crowther KC, sitting as a Deputy, dismissed the appeal as the ET had directed itself correctly and the conclusions it came to were open to it on the evidence.
