Appeal concerning disclosure of documents from disciplinary proceedings conducted by a regulatory body.
The claimant is a professional footballer who brought claims of race discrimination, harassment, and victimisation against QPR, coach Mr Yemms, and Crawley Town, arising from his loan spells at Crawley Town between 2021 and 2022. The FA investigated Mr Yemms, finding him guilty of multiple misconduct charges. The Appellant sought disclosure of the FA disciplinary bundle from Mr Yemms, who held a copy but had failed to comply with the Tribunal's disclosure orders. The employment judge refused the disclosure application so the claimant appealed.
HHJ Tucker allowed the appeal after finding the employment judge had erred in failing to assess properly whether documents were likely to support or adversely affect any party's case though the judge had not been helped by the failure of the second respondent to comply with disclosure as ordered.
