Appeal against a ruling that the ET did not have jurisdiction to consider a claim of victimisation brought by an employee against a fellow employee under Part II of the DDA. Appeal allowed and remitted to the same Tribunal for further case management and hearing.

X v Mid Sussex Citizens Advice Bureau & Ors [2011] EWCA Civ 28
Appeal against decision in EAT, upholding the ET, that the appellant, a volunteer with the Citizens Advice Bureau, was not protected domestic discrimination legislation or the EU Directive. Appeal dismissed.

Royal Bank of Scotland v Ashton UKEAT/0542/09/LA
Appeal against a finding that the respondent had failed to comply with the Disability Discrimination Act 1995 by not making reasonable adjustments for a disabled employee and subjecting her to less favourable treatment than a non-disabled comparator. Appeal allowed and ET judgment reversed.

Aylott v Stockton-on-Tees Borough Council [2010] EWCA Civ 910
Appeal against the judgment of the EAT overturning an Employment Tribunal’s finding of direct discrimination. Appeal allowed on the direct discrimination point but dismissed on the disability-related discrimination claim. Order for compensation restored.

Scottish Opera Ltd v Winning UKEATS/0047/09/BI
Appeal by employer against decision that the claimant should be allowed to amend his claim from a pleading of unfair dismissal to failure to make reasonable adjustments under the DDA 1995, in circumstances where the claimant had suffered a seizure that prevented him from carrying out his driving duties. The employer had argued that the claim was debarred as the claimant had not lodged a corresponding grievance but the EAT upheld the Tribunal decision that the grievance procedure did not apply.

Appeal against finding that the claimant was not suffering clinical depression within the meaning of the Disability Discrimination Act 1995 in circumstances where a job offer had been withdrawn following disclosure of her history of depression. Appeal allowed and remitted to Tribunal.
