[Unfair dismissal - Case Round-Up: March 2014
]()In this month's round-up, Mark Shulman consultant solicitor with Keystone Law looks at recent cases covering constructive dismissal and the "Johnson exclusion zone", misconduct investigations and compensation adjustments.
[Gebremariam v Ethiopian Airlines Enterprise T/A Ethiopian Airlines UKEAT/0439/12/GE]()
Appeal against a finding that the claimant had not been constructively unfairly dismissed. Cross-appeal that the Johnson exclusion zone applied and against a failure by the ET to consider the question of affirmation of the contract by the claimant. Appeal and cross-appeal both allowed in part.
[Kisoka v Ratnpinoytip T/A Rydevale Day Nursery UKEAT/0311/13/LA]()
Appeal against a finding that the claimant was fairly dismissed even though the respondent failed to implement the decision of an independent appeal panel who had allowed her internal appeal. Appeal dismissed.
[Swanston New Golf Club Ltd v Gallagher UKEATS/0033/13/BI]()
Appeal against refusal of a Polkey reduction and a deduction of 33% for contributory fault. Appeal dismissed.
[Jessemey v Rowstock Ltd & Anr [2014] EWCA Civ 185]()
Appeal against a ruling that post-termination victimisation was lawful because s108(7) of the Equality Act 2010 specifically excluded victimisation. Appeal allowed and the matter was remitted to the ET for assessment of compensation
For each question answered correctly 10 minutes of CPD is added to your training record so if you answer all 12 that will give you 2 hours.
