This month's CPD questions relate to:
[The Manchester College v Hazel & Anor ]()[2013] EWCA Civ 281
Application by respondent employers to set aside imposition of a cost protection order as part of their permission to appeal. Application refused.
[The Governing Body of Clarence High School & Nugent Care Society v Boardman ]()[2013] EWCA Civ 198
Appeal against decisions in second ET proceedings that the claimant had been unfairly and wrongfully dismissed. Appeal allowed on unfair dismissal but dismissed regarding wrongful dismissal. A challenge to the decision to remit the matter to a fresh tribunal was also dismissed.
[Davies v Sandwell Metropolitan Borough Council ]()[2013] EWCA Civ 135
Appeal against the decision by the EAT upholding a ruling by the ET that the claimant had been fairly dismissed. Appeal dismissed.
[Rowstock Ltd & Anor v Jessemey (EHRC Intervening)]() UKEAT/0112/12/DM
Appeal against a decision that post termination victimisation could not be pursued because the Equality Act 2010 expressly excludes it. Cross-appeal against a failure to make any Polkey reduction in the compensation awarded. Appeal dismissed, cross-appeal allowed.
[El Kholy v Rentokil Initial Facilities Services (UK) Ltd ]()UKEAT/0472/12/LA
Appeal against a decision that the claimant's ET1 had been lodged out of time and so he could not pursue his claim of unfair dismissal. Appeal dismissed.
For each question answered correctly 10 minutes of CPD is added to your training record so if you answer all 12 that will give you 2 hours.
Barristers: please note that, according to BSB rules, you will have to answer at least 3 questions correctly, equivalent to 30 minutes, for the training to count towards your CPD requirements.
