January 2013 CPD Questions

This month's CPD questions relate to:
[Stringfellows Restaurants Ltd v Quashie]() [2012] EWCA Civ 1735
Appeal against decision in the EAT that the claimant was employed under a contract, reversing the decision of the ET. Appeal allowed.
[London Borough of Hackney v Sivanandan]() [2013] EWCA Civ 22
Appeal against a decision that the ET had no power to apportion, as between the Council and the individual respondents, their joint liability to the claimant for the statutory tort of unlawful discrimination. Appeal dismissed.
[Transport for London v O'Cathail]() [2013] EWCA Civ 21
Appeal by the respondent employer against a decision by the EAT, overturning the ET's refusal to adjourn a hearing and hear the case in the absence of the claimant. Appeal allowed.
[Monk v Cann Hall Primary Shool & Anor]() [2012] EWHC 3819 (QB)
Application by former employer to withdraw previous admissions of breach of duty regarding the manner of the employee's dismissal and for an order striking out the former employee's related claim for personal injury. The claim was struck out.
[Fox & Ors v Bassetlaw District Council ]()UKEAT/0274/12/SM
Appeal against the dismissal of the first set of proceedings following withdrawal, brought against the respondent under rule 25(4) and against the dismissal of a second set of proceedings as an abuse of process. Appeal dismissed.
[Budge & Anor v McGinley Support Services Ltd]() UKEAT/0600/11/BA
Appeal against a 100% Polkey reduction in the awards made to claimants who were found to have been unfairly dismissed. Appeal allowed and remitted to the same Tribunal to consider what the appropriate percentage should be.
For each question answered correctly 10 minutes of CPD is added to your training record so if you answer all 12 that will give you 2 hours.
Barristers: please note that, according to BSB rules, you will have to answer at least 3 questions correctly, equivalent to 30 minutes, for the training to count towards your CPD requirements.
