3 new Presidential Practice Directions published
The President of the Employment Tribunals (England & Wales) has released 3 Practice Directions relating to remote hearings and the use of the Welsh language.
The first Practice Direction can be found here. It concerns hearings held by electronic communication in England and Wales under rule 46 of the Employment Tribunals Rules of Procedure (as set out at Schedule 1 of the Regulations), which can be categorised as remote hearings. Having regard to the paramount importance of the principle of open justice, it addresses methods to safeguard open justice when hearings are conducted remotely.
The second Practice Direction can be found here. It concerns the fixing and conduct of remote and in-person hearings in the Employment Tribunals in England and Wales. Employment Tribunals must have regard to this guidance, but they are not bound by it.
The third Practice Direction can be found here. The purpose of this Practice Direction is to reflect the principle of the Welsh Language Act 1993 that, in the administration of justice in Wales, the English and Welsh languages should be treated equally. It applies to all proceedings before the Employment Tribunals in Wales.
